Information on how to enter the Promotion forms part of these terms and
conditions. Entries not made in accordance with these terms and conditions
will be disqualified.
Section 1: Promotion
1. Promotion: A person shall be eligible to participate
in a lucky draw provided that they submit a bona fide email address on
the official online form during the qualifying period of the lucky draw.
This eligible entrant will be offered an additional entry into the luck
draw for each additional bona fide email address submitted.

3. Promotion Period: The Promotion will commence at 12.01
am on 3rd December 2009 and will close 11.59 pm on 31 December 2009. All
times recorded throughout these terms and conditions are in China Standard
Time.
Section 2: Eligibility
4. Eligibility: To be eligible to enter the Promotion,
the entrant must: (a) be above 18 year of age; and (b) be a Chinese resident.
5. Non-Eligibility: Entrants are not eligible to enter
the Promotion or win any Prize if they are a director or manager, an employee
or immediate family member of an employee of the Promoter, or an employee
of their agencies associated with the Promotion.
6. Further, any personal information or contact details
entered incorrectly on the online enquiry form shall deem the entry as
an invalid entry.
Section 3: Entry to the Promotion
7. When an eligible entrant submits an email address within
the promotion period they will automatically receive one (1) entry to the
Promotion within the Promotion Period as noted in Clause 3. Multiple entries
are permitted when multiple email addresses are provided.
Section 4: Draw
8. Draw: A representative of the Promoter will conduct
a random draw of submitted entries at 11.00 am on 11 January 2010 at AAPC
Shanghai Co Ltd, 21/F, Metro Plaza, No. 555 Lou Shan Guan Road, Shanghai
200051P.R. China. The Prize Winner will be selected at random from a computer-generated
listing of entries that comply with Section 2 and 3 of these terms and
conditions over the Promotion Period.
9. Prize Winner: The Prizes described below in Section
5 will be awarded to the first valid eligible entry drawn in the Draw as
described in Clause 8.
Section 5: Prizes
10. Prize: The prize to be awarded in this Promotion.
The DRAW is a general consumer prize.
11. Prize Components The DRAW:
The consumer prize will comprise all components listed below:
- Return economy airfares for 2 people departing from Shanghai or Beijing
which ever is the nearest city to the Prize Winner’s capital city in Mainland
China bound for Sydney, Australia. Flights, subject to availability, must
be taken between the dates of 1 February 2010 and 30 June 2010 inclusive.
- 5 nights accommodation in a standard room type including breakfast for
2 persons at an Accor Hotel in Sydney, Novotel Sydney on Darling Harbour.
This hotel booking, subject to availability, must be taken between the
dates of 1 February 2010 and 30 June 2010 inclusive.
12. Prize Conditions: Prizes are subject to the following
conditions:
(a) No exchange of Prize: A Prize can be transferred to a person 18 years
or over at the absolute discretion of the Promoter. However, it cannot
be exchanged or redeemed for cash. If for any reason, a Prize Winner cannot
take any component of the Prize and he/she does not wish to transfer the
Prize, then the Prize will be forfeited.
(b) Ancillary Costs: All transport, meals, beverages, spending money, insurances,
service charges, taxes, transfers and ancillary costs, including cost of
travel to and from the airport and the property are not included in a Prize
unless specified and are the responsibility of the Prize Winner.
(c) Taxes: If a Prize or recipient of it incurs a tax liability, the Prize
Winner is liable for payment of such tax.
(d) Prize Availability: All components of the Prize, including accommodation
are subject to availability, and may not be available during school holidays,
holiday weekends or special events. In the event that any component of
a Prize is unavailable for any reason, subject to legislation, the Promoter
reserves the right to substitute that Prize component with another prize
of equal value and the Prize Winner will be notified accordingly.
(e) Prize Itinerary: The itinerary is set by the Promoters and can only
be extended or varied at Prize Winner’s own expense. In the event that
any component of the Prize is unavailable for any reason, the Promoters
reserve the right to substitute that Prize component with another prize
of equal value. The specified dates of the itinerary are subject to change
at any time and the Prize Winner will be notified accordingly.
(f) Notification of Travel Dates: The Prize must be taken between on the
specified dates of 1 February 2010 and 30 June 2010. If the Prize Winner
wishes to transfer their Prize, they must advise the Promoter at the time
of booking.
(g) Date Prize to be Taken: Between the dates of: 1 February 2010 and 30
June 2010
Section 6: Prize Winner
13. Contact: The Promoter
will contact the Prize Winner in writing by mail or email and telephone
by
11 January 2010 to confirm his/her eligibility under these terms and conditions
and to confirm whether the Prize Winner wishes to claim his/her Prize.
14. Claim of Prize: If
the Prize Winner wishes to claim the Prize, the Prize Winner must confirm
this fact and his/her eligibility to win under these terms and conditions
by 10.00 am on 18 January 2010. If the Prize Winner fails to do either
or both of these things by the deadline, the Prize Winner will be deemed
to have forfeited the Prize.
15. Redraw: In the event
that a Prize remains unclaimed by the time and date outlined in condition
15, the Promoters will conduct a redraw, following the same procedure and
format as set out under the Section 4 above. The redraw will take place
at 11.30 am on 19 January 2010 at the same place as the original draw described
in Clause 8.
16. Redraw Winner: The
name of the Prize Winner from any redraw be contact by The Promoter in
writing by mail or email and telephone by 19 January 2010 to confirm his/her
eligibility In the event that this redrawn Prize Winner is not eligible,
the Promoters will conduct a redraw until the Prize is awarded (subject
to any further regulatory directions).
17. The Promoter reserves
the right to redraw in the event of a prizewinner being unable to satisfy
these terms and conditions or forfeiting or not claiming a prize. For a
prize that remains unclaimed or is forfeited through ineligibility or otherwise,
the Promoter will conduct a further draw at the same time and place as
the original draw on 26 January 2010. In the case that a prize is an expired
event (i.e. the event has already taken place), the prize winner/s will
forfeit that portion of the prize. The winner will be notified in writing
immediately
18. Winner Publicity: In accepting the Prize, the Prize
Winner agrees to participate in any publicity arrangements made by or on
the behalf of the Promoter including the writing of a diary / article about
the prize trip no less than 200 words and submit a minimum of 10 photos of
their prize travel experience. The Prize Winner further acknowledges that
the Promoter reserves the right to publicise their name, geographical location
and photographs without any payment being made to them in respect of this
Promotion.
Section 7: General Conditions
19. Lost, Delayed Communication: The Promoter will not be
responsible for any delayed, lost or misdirected mail or any other communication.
20. Release: To the fullest extent permissible by law, each
entrant in the Promotion including without limitation the Prize Winner, releases
the Promoter from any claim, loss, damage, expense (including any claim for
legal expenses), cost or charge sustained or in any way incurred by such
entrant in connection with the Prize or their participation in the Promotion.
The Promoter, its related bodies corporate, their officers, employees and
agents will not be liable for any loss, damage or personal injury whatsoever
(including but not limited to direct, indirect, consequential and economic
loss) suffered or sustained in connection with this Promotion, the promotion
of this Promotion, or the use of any Prize, except for any liability which
cannot be excluded by law. Further, to the fullest extent permitted by law,
the Promoter excludes liability for any problems or technical malfunction
of any telephone network or lines, computer online systems, servers, or providers,
computer equipment, software, technical problems or traffic congestion on
the Internet or any website, or any unauthorised intervention, or any combination
thereof, including any non-delivery or corruption of entries to the Promoter,
injury or damage to participants' or any other person's computer related
to or resulting from participation in or down-loading any materials in this
Promotion. The use of any automated entry software or any other mechanical
or electronic means that allows an entrant to automatically enter repeatedly
is prohibited and will render all entries submitted by that entrant invalid.
21. Force Majeure: Subject to legislation the Promoter will
not be responsible for any act, omission, failure or delay by the Promoter
that is due to an act of God, riots, acts of terrorism, storms, fire, any
labour or industrial dispute, any strike, and other acts, which are not reasonably
within the control of the Promoter.
22. Disputes: In the event of a dispute, the decision of
the Promoter is final and binding and no correspondence will be entered into.
23. Privacy Notice: During the course of the Promotion,
the Promoter may collect personal information in relation to entrants. This
may include, but is not limited to, the names, email addresses, telephone
numbers and credit card details of the entrants, provided by the entrant
on the guest registration form or when paying for services provided by the
participating Hotel. The entrants' personal information is collected so the
Promoter is able to conduct the Prize Draw and to contact and award the Prize
to the Prize Winner, to publish the results of the Promotion and to publicise
the Promotion.
24. Consent to use of Personal Information for Marketing
Purposes: Furthermore, by entering this Promotion, unless otherwise advised
by the entrant, each entrant consents to the retention and use of the information
collected pursuant to Clause 23 by the Promoter, which trades as Accor Asia
Pacific and the Accor Group. For details about who we are, how we may use
your information and what your rights are under the new privacy laws, please
see our Privacy Policy, which is available from the Promoter at the address
provided in Section 1, Clause 2 or online at www.accorhotels.com.cn/privacy.
Uses may include future promotional, marketing and publicity purposes without
any further reference or payment or other compensation to the entrant, or
distribution of marketing materials for goods or services in the tourism,
hospitality and services industries from the Accor Group or from companies
in the tourism and hospitality industry in which the Promoter holds shares.
